A Chief Magistrate Court sitting in the Federal Capital Territory, Abuja, has thrown out a criminal defamation case filed against Nollywood actress Elizabeth Aishat Anjorin, popularly known as Lizzy Anjorin.
According to reports, the court determined that the case lacked merit and was not properly presented. It was reported that the court ruled that the case lacked merit and was not properly brought before it.
The lawsuit, CR/25/20225, was filed by Audullahi Adebimpe Mosadoluwa, the wife of Ibile, a Lagos-based property developer.
Magistrate Sunday A.A. Adukwu dismissed the complaint and ordered the complainant to pay ₦50,000 in costs to the defendants.
Lizzy Anjorin and her co-defendant, Shakira Ayobami, filed a preliminary objection before the ruling was issued.
Through their lawyer, A.U.E. Ogboi, they challenged the court’s authority to hear the case and the competence of the complaint.
The complainant accused the two defendants of criminal defamation, actions likely to disrupt public order, and false and malicious statements.
She filed the case through her lawyer, Yakubu Eleto, and raised concerns about the validity of the summons and the procedures used to bring the defendants before the court.
After reviewing both sides’ arguments and consulting relevant legal authorities, the magistrate ruled in favour of Lizzy Anjorin and Shakira Ayobami.
The court determined that the complainant failed to comply with the provisions of the Administration of Criminal Justice Act of 2015.
The court ruled that while the law requires a complainant to file only one offence in a single criminal complaint, the complainant combined multiple offences in one case.
The magistrate also stated that all parties involved are residents of Lagos State, not the FCT, which hampered the court’s authority to hear the case.
The court concluded that the complaint contained serious procedural flaws and constituted an abuse of court process.
The criminal complaint was dismissed due to incompetence, and the complainant received a ₦50,000 fine.
